Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Throttle service (“Service”) provided by Throttle (“Throttle”, “we”, “us”, “our”). By creating an account or otherwise using the Service, you (“you”, “User”) agree to be bound by these Terms.
1. The Service
Throttle is a route-planning service for motorcyclists. It generates suggested routes between user-supplied waypoints, suggests intermediate stops, and exports the result as URLs and files compatible with third-party navigation services (including but not limited to Google Maps). Throttle does not provide turn-by-turn navigation directly; the Service is a planning aid.
2. Eligibility
You must be at least 18 years old to create an account. By using the Service, you represent that you meet this requirement. The Service is not directed to children under 13 (or under 16 in the EU/EEA).
3. Accounts
You may sign in via email magic link, Google OAuth, or Apple Sign In where enabled. You are responsible for maintaining the security of the inbox or third-party account associated with your sign-in method. You agree to provide accurate information and to keep that information current.
You may close your account at any time through the in-app account settings. On closure, your personal information is deleted; your non-personal route data may be anonymized and retained for service improvement (see the Privacy Policy).
4. Permitted Use
You may use the Service for personal, non-commercial route planning. You agree NOT to:
- Use the Service in violation of any applicable law or regulation
- Reverse engineer, decompile, or disassemble any part of the Service
- Scrape, mass-download, or systematically extract data from the Service
- Use automated means (bots, scripts) to interact with the Service except through documented APIs (we do not currently offer a public API)
- Resell, sublicense, or commercially redistribute Service output
- Interfere with or disrupt the Service or servers connected to the Service
- Misrepresent your identity or impersonate any person or entity
- Use the Service to plan, facilitate, or conduct any illegal activity
- Upload content (in trip names or elsewhere) that is unlawful, defamatory, harassing, threatening, obscene, or infringing of intellectual property rights
We reserve the right to suspend or terminate access to the Service for violations of these restrictions, with or without notice.
Fair use of AI and routing features
Some features call paid third-party services on your behalf — AI trip planning and stop narration (Anthropic), and pre-ride route validation (Google). They’re included with your account, Free and Pro alike, under a fair-use policy: each account gets daily budgets set well above any honest day of ride planning. If you hit one, that feature pauses until the next day (UTC). Route planning, saving trips, and the Google Maps handoff are never affected by these budgets. Accounts that systematically exhaust them — scripts, shared credentials, automated extraction — fall under the restrictions above and may be suspended.
5. Safety Disclaimer
Read this section carefully — it limits Throttle’s liability for matters of road safety.
Throttle generates suggestions only. You, the rider, are responsible for:
- Verifying that all suggested routes are safe, legal, and appropriate for your motorcycle, skill level, weather conditions, and traffic
- Following all traffic laws, signage, and right-of-way rules
- Maintaining attention on the road at all times — Throttle is for pre-ride planning, not in-ride consultation
- Wearing appropriate safety gear (helmet, jacket, boots, gloves) per local law and personal judgment
Suggested points of interest, road conditions, fuel availability, and operating hours are derived from third-party data (OpenStreetMap and others) and may be incomplete, outdated, or incorrect. Always verify critical information (especially fuel availability on long stretches) before relying on it.
The Service is NOT a substitute for situational awareness, motorcycle training, or local knowledge. Throttle makes no representation that any route or stop is safe.
6. Third-Party Services
The Service integrates with third-party services including:
- Google Maps: route export. Use of Google Maps is subject to its own terms.
- OpenStreetMap, Geofabrik, Photon, Nominatim: routing and geocoding data
- Cloudflare: edge networking, bot protection (Turnstile)
- Resend: transactional email delivery
Throttle has no control over these third-party services and is not responsible for their content, performance, or terms.
7. Intellectual Property
The Service and all related content, code, branding, and design are owned by Throttle and protected by U.S. and international intellectual property laws.
You retain ownership of any content you submit (trip names, route preferences, message text). By submitting content, you grant Throttle a non-exclusive, worldwide, royalty-free license to host, display, and process that content as necessary to operate the Service. We do not sell your content or use it for advertising.
8. Pricing and Subscriptions
Throttle offers two tiers:
- Free: account required. Includes curvy route planning, stop suggestions, sharing, sync across devices, and one saved trip slot.
- Throttle Pro: $39.99 USD per year, billed annually. Includes unlimited saved trips and the quick round-trip generator. A 7-day free trial is available — no charge if cancelled before day 15.
Subscriptions auto-renew annually unless cancelled. You can cancel at any time through your account; cancellation takes effect at the end of the current billing period. Refunds are not generally offered for mid-period cancellations.
Payments are processed by Stripe. Stripe’s terms govern the payment transaction; Throttle does not store full payment card details.
We may change pricing for new subscribers at any time. Existing subscribers’ renewal pricing will not change without at least 30 days written notice via the email address on file.
9. Termination
You may terminate your account at any time. We may suspend or terminate your account for breach of these Terms. On termination, your right to use the Service ceases immediately. Sections 5, 7, 10, 11, 12, and 13 survive termination.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THROTTLE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ROUTE SUGGESTIONS ARE COMPLETE, CURRENT, OR SAFE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THROTTLE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE.
THROTTLE’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID THROTTLE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN THOSE JURISDICTIONS THE FOREGOING MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify and hold harmless Throttle, its officers, directors, employees, and affiliates from any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising out of (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any third-party right.
13. Dispute Resolution
Informal resolution first: before filing any legal action, you agree to contact us at hello@throttlerides.com and attempt to resolve the dispute informally for at least 30 days.
Arbitration: any dispute that is not resolved informally will be finally settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will be conducted in English. The arbitrator’s decision will be final and binding. Each party will bear its own costs except as otherwise determined by the arbitrator.
Class action waiver: you agree that any arbitration or court proceeding will be conducted only on an individual basis and not as a plaintiff or class member in any purported class or representative action.
Exception: either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property rights, without first proceeding to arbitration.
14. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms with a new “Last updated” date. For material changes, we will notify registered users by email at the address on file at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
15. Miscellaneous
- Entire agreement: these Terms, together with the Privacy Policy, Acceptable Use Policy, and Cookie Policy, constitute the entire agreement between you and Throttle regarding the Service.
- Severability: if any provision is held unenforceable, the remaining provisions will continue in full force.
- No waiver: failure to enforce any provision is not a waiver of that provision.
- Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
