DMCA & Copyright Policy

⚠️ Draft — review before going live. Standard DMCA notice / takedown language. Unlikely to ever be exercised against Throttle (we don’t host third-party copyrighted content beyond OSM data and the rider’s own trip names) but we have it for completeness.

Sparcgen, Inc. (“Sparcgen”) respects the intellectual property rights of others and expects users of the Throttle service to do the same. We respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”).

If you believe content on Throttle infringes your copyright, send a written notice that includes:

  1. Your physical or electronic signature
  2. Identification of the copyrighted work claimed to be infringed
  3. Identification of the material that is claimed to be infringing, with enough detail to allow us to locate it (a specific URL is best)
  4. Your contact information (address, phone, email)
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on its behalf

Counter-notice

If you believe your content was removed by mistake or misidentification, you may submit a counter-notice that includes:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and the location where it appeared
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification
  4. Your name, address, and phone number, and a statement that you consent to the jurisdiction of the federal court in Delaware (or, if you are outside the U.S., to any judicial district where Sparcgen may be found) and that you will accept service of process from the person who provided the original notice

Repeat infringers

It is our policy to terminate the accounts of users who are determined to be repeat infringers.

OpenStreetMap data

A note on POI and routing data: Throttle uses OpenStreetMap data under the ODbL license. We display OSM-sourced data such as point-of-interest names and locations. Such data is provided under the OSM contributor terms; if you believe specific OSM data is being misused on Throttle, please report directly to OpenStreetMap rather than via DMCA, as OSM data is not generally subject to copyright in most jurisdictions (it’s a database right).
